By using RaiseAComplaint.com, you agree to be legally bound by these Terms. Please read them carefully before using our Platform.
Introduction and Acceptance of Terms
Welcome to RaiseAComplaint.com ("Platform," "Website," "we," "us," or "our"), a U.S.-based online consumer review and complaint platform where individuals may submit complaints, share product or service experiences, rate businesses, and engage with companies toward issue resolution. RaiseAComplaint.com operates as an interactive computer service provider within the meaning of Section 230 of the Communications Decency Act, 47 U.S.C. § 230.
By accessing, browsing, registering on, or otherwise using any feature of this Platform, you ("User," "Consumer User," or "Business User") agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any additional guidelines, rules, or notices published on the Platform.
Definitions
As used throughout these Terms, the following terms have the meanings set forth below:
- "Platform" means the website RaiseAComplaint.com, all its subdomains, mobile-optimized versions, and associated digital services.
- "User" means any individual or entity that accesses or uses the Platform, whether registered or unregistered.
- "Consumer User" means an individual who registers on the Platform to submit complaints, post reviews, upload supporting materials, or share consumer experiences.
- "Business User" means any company, LLC, sole proprietor, partnership, or other legal entity that creates a business account to claim or manage a Company Profile, respond to reviews, or access business analytics through the Platform.
- "Complaint" or "Review" means any text, star rating, photograph, document, or other content submitted by a Consumer User describing a product, service, or business experience.
- "User-Generated Content" or "UGC" means all content—including complaints, reviews, ratings, comments, images, and attachments—submitted or uploaded by any User to the Platform.
- "Company Profile" means a publicly visible page on the Platform dedicated to a specific business or organization, aggregating that entity's reviews, ratings, and complaint data.
- "Business Dashboard" means the private management interface available to registered Business Users to view, respond to, and analyze consumer feedback.
- "Intellectual Property Rights" means all copyrights, trademarks, service marks, trade dress, trade secrets, patents, and any other proprietary or intellectual property rights recognized under U.S. or international law.
Eligibility to Use the Platform
The Platform is intended for use by individuals who are at least 18 years of age. By registering or using the Platform, you represent and warrant that you are 18 years of age or older, legally capable of entering into a binding contract under applicable U.S. law, and not barred from receiving services under U.S. law.
In compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506, this Platform is NOT directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided personal information, we will promptly delete it and close the associated account.
If you are accessing or using the Platform on behalf of a business or legal entity, you represent that you are authorized to bind that entity to these Terms and that the entity accepts these Terms in full.
User Accounts and Registration
- Registration is required to submit reviews, raise complaints, respond to feedback (for Business Users), or access certain features. Consumer Users may register through the free sign-up process; Business Users may register through the dedicated "For Business" portal.
- You agree to provide accurate, current, and complete registration information, including a valid email address and your full name. You are responsible for keeping your account information up to date.
- You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.
- You may not create more than one personal account. Duplicate, fictitious, or fraudulent accounts are strictly prohibited and may be removed without notice.
- We reserve the right to refuse, suspend, or terminate any account at our sole discretion, including where we reasonably believe the information provided is inaccurate, false, or in violation of these Terms.
Complaint Submission Rules
Consumer Users may submit complaints or reviews about businesses listed on the Platform, subject to the following requirements:
- The submission must reflect a genuine, first-hand consumer experience personally encountered by the submitting User.
- The content must be factually grounded and may not be fabricated, materially exaggerated, or submitted for any improper or malicious purpose.
- Users may attach photographs or supporting documents to substantiate a complaint. Uploaded materials must be original, owned by the User, or lawfully in the User's possession, and must not infringe any third-party rights.
- Star ratings must fairly reflect the User's actual experience with the business being reviewed.
- Submissions must be written in respectful language and must not constitute harassment, intimidation, or targeted abuse directed at any individual employee of a business.
All complaints are subject to our multi-step review and authenticity verification process before publication. Businesses are strictly prohibited from submitting fake consumer reviews about their own business or competitors. Any attempt to manipulate ratings or review data is a material breach of these Terms and may expose the offending party to legal liability.
User Responsibilities and Conduct
By using the Platform, every User agrees to:
- Use the Platform solely for its intended purpose of sharing genuine consumer feedback and pursuing legitimate grievance resolution;
- Comply with all applicable laws, including federal and state laws relating to privacy, defamation, intellectual property, consumer protection, and online conduct;
- Respect the rights, dignity, and privacy of all other Users, businesses, and individuals referenced in any content submitted to the Platform;
- Ensure all information provided during registration and in any submission is accurate and truthful; and
- Refrain from any conduct that disrupts, impairs, or interferes with the Platform's operations, servers, infrastructure, or networks.
Business Users additionally agree to respond to complaints and reviews professionally and in good faith, without threatening, harassing, or disparaging Consumer Users; to use Business Dashboard data solely to improve services; and to refrain from incentivizing Consumer Users to modify or remove genuine reviews.
Accuracy of Information and User Representations
By submitting any content to the Platform, you represent and warrant that:
- The content is based on your genuine, personal, first-hand experience and is, to the best of your knowledge, truthful and accurate;
- You have not been paid, incentivized, or otherwise improperly induced to submit or alter the content in a manner that constitutes a deceptive endorsement under FTC guidelines (16 C.F.R. Part 255);
- The content does not infringe any third party's Intellectual Property Rights, privacy rights, publicity rights, or any other legal rights; and
- You have obtained all necessary consents with respect to any personal information or images of third parties included in the submission.
RaiseAComplaint.com does not independently verify the factual accuracy of all User-Generated Content. The Platform functions as an interactive computer service provider under Section 230 of the Communications Decency Act, and the publication of a complaint or review does not constitute an endorsement by the Platform of the claims contained therein.
Prohibited Content and Activities
The following content and conduct are strictly prohibited on the Platform:
- Content that is false, fabricated, misleading, or intended to deceive other Users, businesses, or the Platform;
- Content that is defamatory, libelous, or slanderous under applicable U.S. federal or state law;
- Content that is abusive, threatening, harassing, hateful, obscene, sexually explicit, or otherwise offensive or harmful;
- Content that incites violence or discrimination on the basis of race, color, religion, sex, national origin, disability, sexual orientation, gender identity, or any other protected characteristic;
- Content that infringes upon any third party's copyright, trademark, trade secret, or other Intellectual Property Rights;
- Content that discloses another individual's private personal, financial, or sensitive information without their lawful consent ("doxxing");
- Spam, unsolicited advertising, phishing content, or unauthorized commercial solicitation;
- Use of automated bots, scripts, crawlers, scrapers, or any technology to extract data from or manipulate the Platform without our written consent;
- Submission of fake, duplicate, or coordinated inauthentic reviews or complaints designed to manipulate ratings;
- Any attempt to circumvent, disable, or interfere with the Platform's security, authentication systems, or content moderation processes; and
- Creation of fictitious business profiles or consumer accounts for any fraudulent purpose.
Defamation, False Claims, and Misleading Information
Users are reminded that the submission of false statements of fact about a business or individual that damage their reputation may constitute defamation (libel) under applicable state law and may expose the User to civil liability. Each User who submits content assumes full personal legal responsibility for that content.
While Section 230 of the Communications Decency Act generally protects the Platform as a publisher of third-party content, that protection does not extend to Users who create or submit defamatory, false, or unlawful content.
The Platform does not serve as a venue for competitive attacks, coordinated reputation-damage campaigns, or targeted harassment. Any submission that appears to be motivated by malice rather than genuine consumer grievance may be removed at our discretion without prior notice.
If a business or individual believes that content published on the Platform is defamatory, false, or otherwise unlawful, they may submit a written complaint to us using the procedure described in Section 25. We will review such complaints and take appropriate action, including content removal, where warranted.
User-Generated Content License
By submitting any content to the Platform, you grant RaiseAComplaint.com a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sub-licensable license to use, reproduce, display, publish, translate, distribute, adapt, and create derivative works from such content in connection with the operation, promotion, and improvement of the Platform, in any media or technology now known or hereafter developed.
You retain ownership of your submitted content. By submitting, you represent that you have the right to grant the license above and that your content does not violate any third-party rights.
You acknowledge that your submitted content will be publicly visible, including to the business that is the subject of your complaint, and that such visibility is a core feature of the Platform's mission to promote consumer transparency and accountability. To the extent permitted by law, you waive any moral rights or rights of attribution in connection with UGC you submit to the Platform.
Content Moderation Rights
RaiseAComplaint.com employs a multi-step authenticity and quality verification process before publishing submitted content. Notwithstanding this, we do not guarantee that all published content meets any particular standard of accuracy, completeness, or reliability.
We reserve the right, in our sole discretion and without prior notice or liability, to screen, filter, approve, or reject any content prior to publication; edit or truncate content to correct formatting or remove personally identifiable information; remove, temporarily unpublish, or permanently delete content that violates these Terms; and add editorial disclaimers or contextual notices to content where appropriate.
Our exercise or non-exercise of moderation rights does not create any obligation to monitor all content or to take specific action in response to any particular submission, consistent with Section 230 of the Communications Decency Act.
Complaint Review, Editing, Removal, and Publication Rights
All complaints and reviews are subject to our editorial and moderation policies. We reserve the right to:
- Decline to publish any complaint that does not meet our submission standards or that we have reason to believe is false, misleading, or submitted in bad faith;
- Temporarily remove a published complaint pending investigation of a formal dispute, legal hold, or takedown request;
- Permanently remove a published complaint found to be defamatory, unlawful, or in material breach of these Terms; and
- Mark a complaint as "Resolved" upon confirmation from the Consumer User, the Business User, or based on our own assessment.
Consumer Users may request deletion of their own reviews through their account settings or by contacting us. Deletion requests may not be honored where the content is the subject of an ongoing legal proceeding or where retention is required by applicable law.
Business Responses and Resolution Process
Business Users who have registered and claimed their Company Profile may respond publicly to complaints and reviews about their business. All business responses must comply with these Terms.
Business Users must not use the response feature to threaten, harass, or disparage the Consumer User; make false or misleading counter-claims in violation of the FTC Act; or offer or solicit the removal or modification of a genuine review in exchange for compensation, discounts, or other benefits.
RaiseAComplaint.com facilitates communication between Consumer Users and Business Users but does not act as a mediator, arbitrator, legal representative, or agent of either party. Any resolution achieved through the Platform results entirely from voluntary engagement between the parties involved.
No Guarantee of Complaint Resolution
RaiseAComplaint.com does not guarantee, represent, or warrant that any complaint submitted through the Platform will result in a resolution, response, refund, compensation, replacement, or any other form of redress from the business concerned.
The Platform is a forum for public consumer expression and a channel for facilitating voluntary business engagement. Users are encouraged to simultaneously pursue applicable formal remedies, including filing complaints with the Federal Trade Commission (FTC) at ftc.gov/complaint, the Consumer Financial Protection Bureau (CFPB), their state Attorney General's office, or the Better Business Bureau, as appropriate to their specific situation.
Platform Role and Limitation of Responsibility
RaiseAComplaint.com is an "interactive computer service" within the meaning of 47 U.S.C. § 230(f)(2) of the Communications Decency Act. Consistent with Section 230(c)(1), the Platform shall not be treated as the publisher or speaker of any information provided by another information content provider (i.e., Users).
The Platform does not independently verify the identity of Consumer Users submitting complaints or the accuracy of claims made in those submissions. Publication of content does not imply that the Platform vouches for or endorses its accuracy.
Businesses listed on the Platform may have been listed based on publicly available information or at the request of Consumer Users without prior knowledge or consent of the listed business. Business Users may claim and manage their Company Profile through the "For Business" registration process at no cost.
Intellectual Property Rights
All Platform content that is not User-Generated Content — including the Platform's name, logo, tagline, design, layout, graphics, source code, software, databases, rankings methodology, and editorial content — is the exclusive property of RaiseAComplaint.com and is protected under the U.S. Copyright Act, the Lanham Act, and other applicable intellectual property laws.
No part of the Platform's proprietary content may be reproduced, distributed, republished, modified, reverse-engineered, scraped, sold, or otherwise exploited for any commercial or non-commercial purpose without our prior written consent.
The display of third-party trademarks, company names, and logos on the Platform is solely for the purpose of identification, reference, and review, and does not imply any affiliation with, endorsement by, or sponsorship of the Platform by those trademark owners.
Copyright and Trademark Policy (DMCA Notice & Takedown)
RaiseAComplaint.com complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content on the Platform infringes your copyright, you may submit a written DMCA takedown notice to our designated copyright agent containing:
- Your full legal name, physical address, telephone number, and email address;
- A description of the copyrighted work you claim has been infringed;
- The specific URL or location on the Platform of the allegedly infringing material;
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf; and
- Your electronic or physical signature.
DMCA NOTICES — DESIGNATED COPYRIGHT AGENT
Counter-notification rights are available to Users whose content is removed pursuant to a DMCA takedown, consistent with 17 U.S.C. § 512(g). If you believe content was removed in error, contact us at the address in Section 32.
Third-Party Websites and Links
The Platform may contain hyperlinks to external websites, social media platforms, news sources, or other third-party resources for informational purposes only. Such links do not constitute an endorsement, recommendation, or approval of the linked content, products, services, or their operators by RaiseAComplaint.com.
We have no control over and assume no responsibility for the content, privacy practices, security, or accuracy of any third-party website or resource. Your access to and use of any linked third-party website is entirely at your own risk and governed by that website's own terms of service.
Advertisements and Sponsored Content
The Platform may carry advertisements or promotional placements from time to time. Consistent with the Platform's core commitment to consumer transparency, businesses cannot pay to alter, boost, suppress, or otherwise manipulate their review scores or ratings. All ratings reflect genuine, uncompensated consumer experiences.
Any sponsored or promotional content that appears on the Platform will be clearly labeled as such in compliance with FTC endorsement and testimonial guidelines (16 C.F.R. Part 255). Advertising revenue does not affect the editorial independence of consumer reviews or complaints published on the Platform.
Data Collection and Privacy Reference
The collection, storage, processing, and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the practices described in the Privacy Policy.
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). Please refer to our Privacy Policy for details on how to exercise these rights.
We do not sell personal information to third parties for monetary consideration as that term is defined under the CCPA/CPRA.
Disclaimer of Warranties
We do not warrant that: (a) the Platform will be error-free, virus-free, or secure at all times; (b) access to the Platform will be uninterrupted or continuously available; (c) any complaint submitted through the Platform will generate a response or result in a resolution; or (d) any particular review or rating accurately reflects the business's current products, services, or conduct.
All User-Generated Content represents the individual views and experiences of the submitting Users and does not represent the views, positions, or endorsements of RaiseAComplaint.com. Some states do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.
Limitation of Liability
This limitation applies regardless of whether the claim is grounded in contract, tort, negligence, strict liability, or any other legal theory, and whether or not the Platform has been advised of the possibility of such damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless RaiseAComplaint.com and its owners, officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your access to or use of the Platform;
- Any content you submit, post, or transmit through the Platform;
- Your violation of these Terms or any applicable law;
- Your infringement of any third-party rights, including Intellectual Property Rights or privacy rights; and
- Any false, misleading, defamatory, or unlawful complaint, review, or other submission made by you.
This indemnification obligation survives the termination or expiration of these Terms and your use of the Platform.
Suspension and Termination of Accounts
We reserve the right to suspend, restrict, or permanently terminate any User account, with or without prior notice, at our sole discretion, including where a User has violated any provision of these Terms; submitted content that is false, defamatory, harassing, or unlawful; or created multiple or duplicate accounts.
Upon termination, your right to access the Platform ceases immediately. Content previously submitted may be retained or removed at our discretion, subject to applicable legal requirements. Users whose accounts have been terminated for violations of these Terms are prohibited from re-registering on the Platform without our prior written consent.
Reporting Abuse or Violations
The Platform provides a reporting mechanism for Users and third parties to flag content or conduct they believe violates these Terms, constitutes abuse, or is otherwise unlawful.
Reports may be submitted by contacting us at the address in Section 32, clearly identifying the relevant content by URL, the nature of the alleged violation, and any supporting information or documentation. We will review all reports in good faith and take action where warranted.
Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Subject to the binding arbitration and class action waiver provisions of Section 27 below, any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, United States. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in those courts.
Dispute Resolution, Binding Arbitration, and Class Action Waiver
27.1 Informal Resolution
Before initiating arbitration, the parties agree to attempt informal resolution for a period of thirty (30) days. You may contact us at the address in Section 32 with a written description of the dispute.
27.2 Binding Arbitration
If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or the breach, termination, or invalidity thereof shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (available at www.adr.org). The arbitration shall be conducted by a single neutral arbitrator. The seat of arbitration shall be Wilmington, Delaware, United States.
27.3 Class Action Waiver
27.4 Exceptions
Either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits. Either party may seek emergency injunctive or other interim relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
27.5 Opt-Out
You may opt out of the binding arbitration and class action waiver provisions of this Section by sending written notice to us within thirty (30) days of first accepting these Terms. Your notice must include your name, email address used for registration, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms.
Force Majeure
RaiseAComplaint.com shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, governmental actions or regulations, internet or telecommunications service disruptions, third-party platform outages, or cyberattacks.
In such circumstances, our obligations shall be suspended for the duration of the force majeure event, and we will use commercially reasonable efforts to resume normal operations as promptly as practicable.
Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
Waiver
No failure or delay by RaiseAComplaint.com in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of the same or any other right. A waiver of any specific breach or provision shall not be construed as a waiver of any subsequent breach of the same or any other provision of these Terms.
Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this document and, where reasonably practicable, provide notice to registered Users via email or a prominent notice on the Platform.
Your continued use of the Platform after revised Terms have been posted constitutes your acceptance of those revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may request deletion of your account. We encourage you to review these Terms periodically to stay informed of any updates that may affect your rights.
